Do Pedestrians Always Have the Right of Way?

Under Florida law, pedestrians are required to yield to vehicles in the following situations:

  • When the pedestrian is crossing a roadway at any other point than a marked or unmarked crosswalk
  • When there is a “do not walk” or “wait” signal, or when there is a red light in the direction the pedestrian wishes to cross if there is no marked crosswalk
  • When crossing a roadway in an area where there is a designated pedestrian tunnel or overhead walkway that they could use

Additionally, pedestrians should always use sidewalks when they are available and are not permitted to cross intersections that do not have designated crosswalks when the next intersection does have a marked or unmarked crosswalk.
