Who Can File a Personal Injury Claim?

How Long Do I Have to File a Personal Injury Claim in Florida?

According to the Florida Statutes section 95.11(3)(a), the statute of limitations for personal injury claims in the state of Florida is four years. The statute of limitations is a state law which limits how long injury victims have to file a before they lose their right to do so.

Specifically, this law states that you have four years from the date your injury occurred, or you will almost certainly lose your right to compensation. It’s important to note that there are exceptions that can change this time limit. Some examples of these exceptions include:

  • If the injury victim was a minor when the accident occurred
  • If the injury victim was legally mentally incapacitated when the accident occurred
  • If the alleged negligent party leaves the state before a claim can be filed
